Final grade is composed of two elements: 1. Case-law analysis (30%) and 2. Final essay (70%) 1. Case-law analysis: case decided (after 2010) by the European Court of Human Rights (Strasbourg), the Court of Justice of the EU (Luxembourg) or a constitutional/supreme court from an EU state. Case should be of “constitutional” nature, i.e. going beyond issues of only “technical” application of law. Length and format of case study: 1000 words, pdf. Case-study shall include facts of the case, legal problem to be solved, arguments of both parties, decision of the court, its reasoning and follow-up of the case. Deadline: January 25, 2024 (delayed submission until 1 February is accepted by penalised by reduction of 10 points) 2. Final essay: an analysis / memorandum on a structural or policy problem covered by the course (example: border controls on internal Schengen borders and their practical and symbolic impact). Choice of essay topic can be consulter until December 15, 2022. Essay shall include analysis of current situation, identification of current challenges, potential future reforms and recommendation for their implementation. Length and format of case study: 4000 words, pdf. Deadline: January 25, 2024 (delayed submission until 1 February is accepted by penalised by reduction of 10 points) Grading uses scale A-F, in accordance of the respective regulations adopted by the FSV. Grading: · A: 100-91 points · B: 90-81 points · C: 80-71 points · D: 70-61 points · E: 60-51 points . F : 0 - 50 points |
