Anotace -
The course covers the specifics of criminal and civil liability in the health care sector. Both types of liability are given approximately the same amount of instruction, beginning with a summary of the basic principles of each liability type and continuing with seminars on individual sub-issues related to the application of the liability in healthcare. The overall approach is designed to enable students to understand or deepen their understanding of the basic concepts of legal liability and their application to specific liability issues in healthcare. These include, in particular, offences specific to the healthcare sector, procedural aspects of medico-legal litigation (especially in terms of evidence) or specific issues of civil liability (e.g. compensation for secondary injury, liability for injury sustained in home birth or liability in medical research). Emphasis will be placed on developing the ability to analyse and apply legal rules, to compare solutions in different legal systems and, in particular, argumentation skills.
Students with an initial general knowledge of criminal and civil law may achieve a deepening of their knowledge in a specific health law area. The course is also open to students without in-depth introductory knowledge of these areas who are interested in specific issues of legal liability in healthcare.
Throughout the course, a strong emphasis is put on interactive teaching methods, discussion, and team and independent student work.
